1. Acceptance of These Terms

These Terms of Service form a binding agreement between you and Noc Cosmetics Inc. They govern your access to the website https://www.noc.hair and every order, consultation, subscription or partnership you conduct with us through it. The website itself is designed and operated by the developer NOCCOST on behalf of Noc Cosmetics Inc., a company located at 263 av Grand Trunk, Maple - L6A 4B3, Canada (CA). By browsing the site, placing an order or booking a session, you confirm that you have read these terms and accept them.

If you do not accept these terms, please stop using the website and contact us at serve@noc.hair so we can close any open requests. Nothing in these terms removes rights that consumer law grants you and that cannot be waived by contract. Where a separate signed agreement exists, such as a wholesale supply contract, that agreement prevails over these terms for the activities it covers, and these terms continue to apply to everything else.

2. Who We Are and What We Do

Noc Cosmetics Inc. is a colour and skincare house. We formulate cleansers, serums, creams, lipstick bullets, compacts, palettes, nail polish, fragrances and body care in small batches in our Maple studio, release themed seasonal collections through the year and provide personalized shade consultations both in person and by video. We also supply boutiques, salons and pharmacies through a managed retail and wholesale program.

These terms cover the online side of that work: the website, its content, the ordering system, the contact and booking channels and the information we publish about products and services. Details of physical retail arrangements are set out in each partner contract. If you are ever unsure whether an activity falls under these terms, write to serve@noc.hair or call +14408191037 and we will tell you which rules apply before you proceed.

3. Eligibility to Use the Website

You must be at least eighteen years old, or the age of majority in your place of residence, to place an order or book a consultation through the website. Minors may of course receive our products as gifts, but the purchase itself must be completed by an adult. By using the site you confirm that the information you provide is accurate, current and yours to share.

You agree to keep your contact details up to date so that order confirmations, shipping notices and consultation reminders reach you. We may suspend or refuse service where we reasonably suspect fraud, resale of trial samples as full products, abuse of promotions or conduct that endangers our staff or other customers. Suspension is a last resort; wherever possible we contact you first, explain the concern and give you a chance to resolve it.

4. Products and Descriptions

We describe every product with care: shade, finish, size, key actives, texture and the skin types it was tested on. Photography is shot in controlled light to show colour faithfully, yet screens differ, and a displayed shade can look slightly different on your device or on your skin. Detailed ingredient lists appear on each product page and on every package, and we update them whenever a formula changes.

Cosmetics are personal products. For that reason, we publish patch-test guidance for every category and recommend testing a small amount on the inner forearm before first full use, especially for sensitive skin. Our compendium notes, blog articles and consultant suggestions describe typical results; they are not guarantees of an identical outcome for every person, because skin, climate and routine all influence how a formula performs from one face to the next.

5. Orders, Payment and Billing

When you place an order, you make an offer to buy the items in your basket. We accept that offer when we send an order confirmation to your email address at which point a contract is formed for those items. Until confirmation is sent, we may decline an order, for example when an item has just sold out, when an address falls outside our delivery regions or when payment verification fails.

Payment is taken through our payment processor at the moment of acceptance. We accept the card and wallet methods displayed at checkout and never see or store your full card number. You agree not to pay with methods you are not authorized to use. If a payment is reversed after shipment, we will contact you to arrange resolution, which may include return of the goods or repayment of the amount due. Invoices are issued by email and can be re-sent on request.

6. Pricing, Taxes and Currency

Prices are displayed in Canadian dollars and, where shown, in other currencies for guidance only; the charged amount is always the Canadian dollar figure converted by your card issuer at its own rate. Applicable sales taxes are calculated at checkout based on the delivery address and are itemized on your invoice. Shipping costs, where they apply, are shown before you confirm payment.

We may change prices, run promotions or retire shades at any time, but such changes never alter an order that has already been confirmed. If we discover a clear pricing error after confirmation, we will contact you before charging or shipping, explain the correct figure and let you choose to proceed or to cancel with a full refund. Misuse of promotional codes, including resale of bulk redemption, may lead to code cancellation without notice.

7. Shipping, Delivery and Risk

We ship to every Canadian province and territory and to a growing list of international destinations shown at checkout. Orders are normally prepared within two business days and handed to a carrier the same or next day. Tracking is sent by email as soon as the parcel is scanned. Delivery estimates are provided in good faith, but carrier delays, weather and customs handling can extend them, and such extension is outside our control.

Risk of loss passes to you on delivery to the address you provided or to a pickup point you selected. If a parcel arrives damaged, photograph the packaging and contents and write to serve@noc.hair within seven days so we can arrange a replacement or refund with the carrier. If tracking shows delivery but the parcel cannot be found, check with household members and the carrier first; we will open an investigation with the carrier on your behalf and keep you informed.

8. Returns, Exchanges and Refunds

Unopened products in original, undamaged packaging may be returned within thirty days of delivery for a refund to the original payment method. Opened cosmetics generally cannot be resold for hygiene reasons, so returns of opened items are limited to situations where a product is faulty, differs materially from its description or caused a verified adverse reaction documented by a health professional.

To start a return, write to serve@noc.hair with your order number and reason; we reply with instructions and the return address in Maple. Refunds are issued within ten business days of the returned item passing inspection, and return shipping is paid by us whenever the return results from our error. Consumable samples, gift cards and items marked final sale cannot be returned unless faulty. Nothing in this section limits mandatory consumer return rights in your region.

9. Consultations and Beauty Advice

Consultations are personal beauty guidance sessions, not medical appointments. Our consultants are trained in shade theory, formulation knowledge and routine building. During a session we study your skin in suitable light, discuss concerns and preferences and prepare a written routine with product and shade recommendations. Advice is general beauty guidance and is not diagnosis, treatment or a substitute for advice from a physician or dermatologist.

Sessions may be rescheduled or cancelled free of charge up to twenty-four hours before the start time by email or telephone. Later cancellations and missed appointments may forfeit the session fee where one applies. We keep brief notes of each session so future appointments build on past ones; you can ask for a copy of your notes or ask us to amend them at any time. If a recommended product irritates your skin, stop use and tell us, so we can adjust the plan and record the response.

10. Acceptable Use of the Website

You may use the website for lawful personal and business purposes connected to our products and services. You agree not to interfere with its operation, not to attempt unauthorized access to accounts, servers or data, not to scrape content at volumes that burden the service and not to introduce malicious code of any kind. Automated ordering tools that bypass fair purchase limits are not permitted.

When you submit content to us, such as reviews, photographs or messages, you confirm that it is yours to share and does not infringe the rights of others or contain unlawful, harassing or misleading material. We may moderate or remove submitted content that violates these rules. Repeated abuse may lead to a ban from the site and, where the conduct is criminal, a report to the appropriate authorities. We treat respectful communication in both directions as part of the service.

11. Intellectual Property Rights

The NOCCOST name, the Noc Cosmetics Inc. name and logo, shade names, product photography, the compendium texts, page layouts, code and all other content on this website are owned by Noc Cosmetics Inc. or licensed to us, and they are protected by Canadian and international copyright, trademark and related laws. All rights not expressly granted to you in these terms are reserved.

You may view, download and print pages for personal, non-commercial use connected to shopping with us. You may not reproduce, publish, sell or redistribute site content for commercial purposes without our written permission. Wholesale partners receive a limited licence to use approved product imagery and descriptions in their own channels according to their supply agreement. Permission requests are welcome at serve@noc.hair and are usually answered within five business days.

12. Links to Other Websites

Our pages may link to partner boutiques, carriers, payment providers, social platforms and press coverage. Those sites operate under their own terms and privacy notices, and we do not control their content or practices. A link exists for your convenience and does not mean we endorse everything the destination publishes or sells.

If you operate a website and wish to link to ours, you may do so provided the link is fair, does not misrepresent your relationship with us and does not frame our pages as your own. We may withdraw linking permission at any time. If you find a link on our site that leads somewhere unexpected or unsafe, report it to serve@noc.hair; we will review and remove it promptly if it no longer serves our customers.

13. Disclaimers

The website is provided on an as-is and as-available basis. While we work hard to keep pages accurate, stocked and online, we do not warrant that the site will be uninterrupted, error-free or free of harmful components, and we do not warrant that every description, photograph or shade rendering will be perfectly complete on every device. We do, however, commit to correcting confirmed errors quickly and transparently.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement in relation to the website itself. Nothing in these terms disclaims warranties that cannot be disclaimed under consumer law, and nothing here affects your statutory rights regarding the products we sell, which remain of satisfactory quality and as described. Cosmetic advice published on the site is general guidance, as explained in the consultation section above.

14. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising from your use of the website or from any order is limited to the greater of the amount you paid for the products or services giving rise to the claim, or one hundred Canadian dollars. We are not liable for indirect, incidental, special or consequential losses, including lost profits, lost data or missed opportunities, however they arise.

These limits do not apply where the law forbids them, including liability for death or personal injury caused by negligence, for fraud, for fraudulent misrepresentation or for any liability that cannot lawfully be excluded. Nothing in this section limits your rights as a consumer to remedies for defective goods or misdescribed services. If any part of this section is held unenforceable, the remainder continues to apply to the fullest extent the law allows.

15. Indemnification

You agree to indemnify and hold harmless Noc Cosmetics Inc. and its staff against claims, damages, losses and reasonable legal costs arising from your breach of these terms, your misuse of the website or content you submit that infringes the rights of another person. This protection does not extend to harm caused by our own negligence, our products or our breach of these terms.

If a claim covered by this section is brought against us, we will notify you at the email address on file and provide a reasonable opportunity to respond. You agree to cooperate in good faith with our reasonable requests for information related to the claim. We reserve the right to control the defence of any matter for which we are required to be indemnified, using counsel of our choice at our own cost where the claim does not arise from your breach.

16. Governing Law and Dispute Resolution

These terms and every dispute arising from them are governed by the laws applicable in the Province of Ontario, Canada, without regard to conflict-of-law rules that would apply another body of law. Consumer protection statutes of your place of residence continue to apply where they cannot be contracted out of, and nothing in this section deprives you of protections you are granted as a consumer.

Before starting formal proceedings, we ask you to contact us at serve@noc.hair or +14408191037 so we can try to resolve the matter directly; most concerns are settled quickly at this stage. If direct resolution fails, the courts located in Ontario, Canada have jurisdiction, except that you may bring a consumer claim in the courts of your own residence where the law permits. We will always comply with a final decision of a competent court or tribunal.

17. Changes to These Terms

We may revise these terms to reflect new services, legal developments or operational improvements. The current version is always published on this page with an updated effective date at the top. When a revision is material, we will announce it on the website and, for active subscribers and open orders, by email before it takes effect.

Orders placed before a revision takes effect are governed by the version that applied when the order was confirmed. Continued use of the website after the effective date of a revision constitutes acceptance of the revised terms. Archived versions are retained in our records and can be supplied on request, so you can always see exactly which wording governed a particular purchase or session in the past.
